Cosmetics manufacturers don't need FDA pre-approval, but must comply with FDA regulations. Since 2023, MoCRA (Modernization of Cosmetics Regulation Act) requires US-market cosmetics facilities to register with FDA. Ingredients must comply with FDA-prohibited lists. Labeling must include INCI names, warnings, and net content in US measurements. Products with drug claims require NDA/OTC approval.
GMP (Good Manufacturing Practice) for cosmetics is codified in ISO 22716. A certified factory has documented procedures for production, quality control, raw material testing, personnel hygiene, and facility maintenance. ISO 22716 is required for EU cosmetics imports (EC 1223/2009) and is a strong quality indicator for all markets. Always request ISO 22716 certificates and conduct a factory audit before placing cosmetics orders.
Private label MOQ by product: lip products 500–1,000 units, skincare 300–500 units, nail polish 500–1,000 units. Custom formulation requires higher MOQs (1,000–5,000 units) plus formulation fees ($500–2,000). Ready-formula white label: 200–500 units. Many Guangzhou factories are flexible with small brands on first orders. Always request a Certificate of Analysis (CoA) for each batch.
EU Cosmetics Regulation (EC) 1223/2009 requires: safety assessment by a qualified EU assessor, product information file (PIF), CPNP notification, EU responsible person, INCI ingredient list, correct labeling. The EU Restricted Substances list prohibits 1,300+ ingredients. Consider hiring a regulatory consultant for EU market entry. Parabens, certain preservatives, and microplastics face additional restrictions from 2025 onwards.
